Official: Man's NYC arrest in Lohan dispute voided

NEW YORK (AP) ? A 25-year-old man initially arrested Sunday on an assault charge after Lindsay Lohan claimed he grabbed her in her New York hotel room in an argument over cellphone images was freed hours later and his arrest voided when the charge could not be substantiated, law enforcement officials said.

Instead, Christian LaBella of Valley Village, Calif., and Lohan filed harassment complaints with police against each other after they were interviewed by police about their run-in, law enforcement officials said.

Afterward, Lohan publicist Steve Honig expressed outrage that police did not charge LaBella.

"We think it's both distressing and outrageous," he said in a telephone interview. "Lindsey was assaulted and there needs to be a consequence for that."

LaBella could not be reached for comment.

LaBella was taken into custody about 6 a.m. after a 911 call came from the swank W Hotel in Manhattan's Union Square where Lohan apparently pulled the fire alarm, the two officials said. The officials were not authorized to speak publicly and spoke to The Associated Press on condition of anonymity.

A former congressional aide, LaBella was arrested on a misdemeanor assault charge but released later Sunday. The charge could not be substantiated so the arrest will be voided, the officials said.

The paperwork was being completed on cross-harassment complaints, which are considered a violation, and no other legal action would be taken, the officials said.

Lohan and LaBella met hours earlier at a night club, though it was unclear whether they previously knew each other, the officials said. They went back to her room, when she noticed the cellphone photos of her on his phone and grabbed the device, the officials said.

She claimed LaBella grabbed her and threw her, but later he said she had forcefully taken his phone, the officials said. Lohan was injured but not hospitalized, Honig said in a statement.

"Lindsay has spoken with police and is fully cooperating with the investigation," he said after LaBella's arrest.

This is Lohan's second run-in with law enforcement in as many weeks in New York City. The 26-year-old was accused last week of clipping a pedestrian with her car outside a nightclub and driving away. She was given a ticket and was scheduled to appear in court Oct. 23. Honig has said he expects those allegations to be proven false.

The actress was also involved in a car accident in California this summer that sent her and an assistant to a hospital, but didn't result in serious injuries for anyone. The accident remains under investigation.

In May, she was cleared of allegations that she struck a Hollywood nightclub manager with her car.

Lohan remains on informal probation for taking a necklace from a jewelry store without permission last year. That means she doesn't have to check in with a judge or probation officer but could face a jail term if arrested again.

Lohan recently filmed "The Canyons," an indie film written by "Less Than Zero" and "American Psycho" author Bret Easton Ellis.

Steve Tomaszewski, a spokesman for Illinois Rep. John Shimkus, confirmed Sunday afternoon that LaBella has worked for the congressman in his Washington office. Tomaszewski said no one from the Republican's office had been contacted by LaBella.

NHL, locked-out players resume bargaining

NEW YORK (AP) ? The NHL and the players' association agreed on issues related to player safety and drug testing Friday, but the core economic divide that is preventing an end to the league's latest lockout was not even on the agenda.

The sides returned to the bargaining table after more than two weeks apart, and some progress was made in about two hours of discussions during a morning session.

"You would absolutely hope that things progress and kind of catch fire, but right now we're just going to take it one step at a time and try to come to an agreement on as many issues as possible," said former player Mathieu Schneider, now an NHLPA special assistant to the executive director. "We're taking baby steps right now."

NHL Commissioner Gary Bettman took part in Friday morning's talks, but union head Donald Fehr wasn't present. He is expected to join the discussions during the course of the three-day meeting.

After breaking for lunch, the sides were expected to reconvene later Friday and then again on Saturday and Sunday.

"It says that both sides are committed to getting back to the table and working," Schneider said.

Schneider added that there were agreements on more rigorous drug testing, including increasing it to parts of the year during which testing is not currently done.

Both sides are on the same page in believing that the use of performance-enhancing drugs is not a problem in the NHL.

"We're in agreement that it's not an issue in our sport," Schneider said. "I think it's in the players' best interest as well as the sport to close off any possible time during the year where players could use."

Other topics on tap for Friday and through the weekend are various health and safety issues, time players spend at training facilities, and other non-economic topics.

"We like to say that nothing is agreed to until everything is agreed to, but we've certainly made some headway," Schneider said. "A lot of it was done previous to this morning. We're taking notes of where we stand. I would say that we have a lot of mutual ground that we have found agreement on."

It is not impossible that monetary issues will come up for discussion in this round of talks, they just aren't scheduled. Neither side has indicated it is prepared to make a new offer now regarding how to split up the more than $3 billion annual pot of hockey-related revenue.

"In general, when you're dealing with collective bargaining, when you start to have agreements on smaller issues, it can lead to bigger issues," Schneider said, "but it's still too early to say."

These are the first talks since the lockout was put in place on Sept. 16 and they came a day after the league canceled the remaining preseason games. The regular season is to start Oct. 11.

When Brian Hall, former House Majority Leader Dick Armey, and other over-65 retirees requested to opt out of Medicare?s hospital insurance coverage (because they preferred their existing private coverage), the Social Security Administration didn?t thank them for saving taxpayers? money. Instead, the SSA explained that, because of a guideline in its ?Program Operations Manual System??essentially a manual that explains how to operate the Social Security system?anyone who declined Medicare benefits would lose Social Security.

That is, Hall and the others could disclaim their Medicare hospital insurance coverage, but only if they forfeited all of their future claims to Social Security and repaid whatever benefits they already had received ? roughly $280,000 altogether. The plaintiffs challenged the linking of Social Security and Medicare as being beyond the SSA?s statutory authority. Neither the Social Security Act nor the Medicare Act allows administrative agencies to precondition benefits under one program on acceptance of benefits from other. Instead, the plain language of both statutes states that petitioners are ?entitled? to benefits, which according to legal and general usage describes someone who is ?legally qualified? and thus has the option of claiming benefits.

The district court disagreed and the U.S. Court of Appeals for the D.C. Circuit, in a split decision, affirmed the trial court?s result but declined to grant the POMS rules deference. The court then unanimously denied a petition for rehearing. Recognizing that the D.C. Circuit ruling, if left in place, could encourage future encroachments on congressional power by administrative agencies, Cato filed an amicus brief?supporting Hall?s request that the Supreme Court take the case and enforce the statute as it was written.

We note that administrative agencies have no powers not granted to them by Congress and that regulations must be anchored in the operative statute?as well as the agency?s fair and considered judgment?in order to warrant judicial deference. The POMS regulation fails this standard because Congress?s use of the word ?entitled? was clear and unambiguous. Combined with the fiscal irresponsibility of forcing citizens to accept costly benefits in an economic recession, the POMS rule appears to be an arbitrary power grab rather than a faithful effort to implement the will of Congress. We conclude by reminding the Court that agency overreach imperils the separation of powers and therefore liberty.

When Congress fails to counter an unauthorized expansion of power by an administrative agency, the judiciary has a duty to uphold the Constitution by enforcing the relevant statute as written.

The Supreme Court will decide later this fall whether to take the case of Hall v. Sebelius.

Scrapbooking With Material | Home and Family

If you are a scrapbooker, chances are that you also do other crafts such as quilting and sewing. This could be very useful, especially if you have enough material on that you have saved but do not know why! There are several things you can do with the content of the pages of your album. The good thing is, you need very little equipment and can get the vestige of use scrapbook pages.

Search hardware that is not too busy or colorful background and you can do it on your layout. Not only the technical background fast, but it is your page depth and texture.

To use up remnants of a very small reasonable thickness covering a piece of cardboard to avoid bending when you cover it. Either the material strip on the back of the adhesive or the use of cards. The card must be large enough to make a border around your main photo. Now you can attach your photo in the center of the card. The black and white you can use virtually any piece of content.

Other use of your content embellishments for your layout. To make a flower you need a small circle of double-sided adhesive paper on one inch in diameter (I use paper ?Jac?). Cut a strip of say 2 inches wide and 7.5 inches long. Delaminate one side of the circle and one end of the adhesive material, because of which the center of the circle. Now work your way around the circle, gather the material in about half an inch bites until you work your way to the right around the circle. To hold the material in place, whether basic or just use a few points to keep. You really need to hide the staple or sew and I would do great with brads or buttons. Everything you do now that you back off the sticky paper and put the flower on your main page.

Nickelblock: An element's love-hate relationship with battery electrodes

Anyone who owns an electronic device knows that lithium ion batteries could work better and last longer. Now, scientists examining battery materials on the nano-scale reveal how nickel forms a physical barrier that impedes the shuttling of lithium ions in the electrode, reducing how fast the materials charge and discharge. Published last week in Nano Letters, the research also suggests a way to improve the materials.

The researchers, led by the Department of Energy's Pacific Northwest National Laboratory's Chongmin Wang, created high-resolution 3D images of electrode materials made from lithium-nickel-manganese oxide layered nanoparticles, mapping the individual elements. These maps showed that nickel formed clumps at certain spots in the nanoparticles. A higher magnification view showed the nickel blocking the channels through which lithium ions normally travel when batteries are charged and discharged.

"We were surprised to see the nickel selectively segregate like it did. When the moving lithium ions hit the segregated nickel rich layer, they essentially encounter a barrier that appears to slow them down," said Wang, a materials scientist based at EMSL, the Environmental Molecular Sciences Laboratory, a DOE user facility on PNNL's campus. "The block forms in the manufacturing process, and we'd like to find a way to prevent it."

Lithium ions are positively charged atoms that move between negative and positive electrodes when a battery is being charged or is in use. They essentially catch or release the negatively charged electrons, whose movement through a device such as a laptop forms the electric current.

In lithium-manganese oxide electrodes, the manganese and oxygen atoms form rows like a field of cornstalks. In the channels between the stalks, lithium ions zip towards the electrodes on either end, the direction depending on whether the battery is being used or being charged.

Researchers have known for a long time that adding nickel improves how much energy the electrode can hold, battery qualities known as capacity and voltage. But scientists haven't understood why the capacity falls after repeated usage -- a situation consumers experience when a dying battery holds its charge for less and less time.

To find out, Wang, materials scientist Meng Gu and their collaborators used electron microscopy at EMSL and the National Center for Electron Microscopy at Lawrence Berkeley National Laboratory to view how the different atoms are arranged in the electrode materials produced by Argonne National Laboratory researchers. The electrodes were based on nanoparticles made with lithium, nickel, and manganese oxides.

First, the team took high-resolution images that clearly showed rows of atoms separated by channels filled with lithium ions. On the surface, they saw the accumulation of nickel at the ends of the rows, essentially blocking lithium from moving in and out.

To find out how the surface layer is distributed on and within the whole nanoparticle, the team used a technique called three-dimensional composition mapping. Using a nanoparticle about 200 nanometers in size, they took 50 images of the individual elements as they tilted the nanoparticle at various angles. The team reconstructed a three-dimensional map from the individual elemental maps, revealing spots of nickel on a background of lithium-manganese oxide.

The three-dimensional distribution of manganese, oxygen and lithium atoms along the surface and within the particle was relatively even. The nickel, however, parked itself in small areas on the surface. Internally, the nickel clumped on the edges of smaller regions called grains.

To explore why nickel aggregates on certain surfaces, the team calculated how easily nickel and lithium traveled through the channels. Nickel moved more easily up and down the channels than lithium. While nickel normally resides within the manganese oxide cornrows, sometimes it slips out into the channels. And when it does, this analysis showed that it flows much easier through the channels to the end of the field, where it accumulates and forms a block.

The researchers used a variety of methods to make the nanoparticles. Wang said that the longer the nanoparticles stayed at high temperature during fabrication, the more nickel segregated and the poorer the particles performed in charging and discharging tests. They plan on doing more closely controlled experiments to determine if a particular manufacturing method produces a better electrode.

Work-family conflict translates to greater risk of ... - Medical Xpress

Nurses and other hospital workers, especially those who work long hours or the night shift, often report trying to juggle the demands of the job and family obligations. A study out today by The George Washington University School of Public Health and Health Services (SPHHS) suggests that the higher the work-family conflict the greater the risk that health care workers will suffer from neck and other types of musculoskeletal pain.

"Work-family conflict can be distracting and stressful for hospital employees," says lead author of the study Seung-Sup Kim, a postdoctoral scientist and professorial lecturer in environmental and occupational health at SPHHS. "Hospitals that adopt policies to reduce the juggling act might gain a host of benefits including a more productive workforce, one that is not slowed down by chronic aches and pains," Kim said.

The study fits into a growing body of evidence showing that conflict between increased workloads or long hours can spill over into domestic life and adversely affect workers on the front lines of patient care. Other research suggests that work-home conflict can put workers at risk of depression, substance abuse and even heart disease. But could the stress of trying to care for multiple sick patients on a hospital ward and manage the domestic front actually lead to physical pain?

Kim and principal investigator, Glorian Sorensen, PhD, Professor of Society, Human Development and Health at Harvard School of Public Health and other researchers decided to try to find out by conducting a survey among 2,000 hospital workers who provided direct patient care in two large Boston hospitals. Nearly 80 percent of the workers took the survey and the team ended up including a total of 1,199 patient care workers in the current analysis. The team assessed work-family conflict with five questions. They asked workers if they agreed with statements like: "The amount of time my job takes up makes it difficult to fulfill family or personal responsibilities" and "My job produces strain that makes it difficult to fulfill my family or personal responsibilities."

In addition, the researchers used a questionnaire to assess how much the participants in the study experienced musculoskeletal pain during the previous three months. And they also took note of factors that might affect the outcome of the study, such as the amount of on-the-job lifting or pulling?which could strain muscles and lead to pain.

The researchers discovered that nurses and other employees who reported high conflict between their job duties and obligations at home had about a 2 times greater chance of suffering from neck or shoulder pain in the last three months. And workers with the highest work-life imbalance had nearly a 3 times greater risk of reporting arm pain during that period.

All told, the researchers found that workers who reported lots of conflict had more than a 2 times greater chance of experiencing any kind of musculoskeletal pain. At the same time, the research found no lasting link between this kind of ongoing conflict and lower back pain, which might be caused when hospital workers lift heavy patients on a regular basis, Kim said.

Hospital workers, and especially nurses, often pull double shifts or work the night shift, and in some cases are handling heavy volumes of very sick patients. The conflict between on-the-job duties and home responsibilities?such as taking calls about a forgetful parent who has wandered off?can, as this study suggests, lead to chronic bodily pain?and possibly other health problems.

The consequences of that unhealthy cycle are serious and affect not just hospitals but society at large, Kim says. He says that the work-home conflict might exacerbate shortages of key health professionals caused when burned-out nurses or other health professionals retire early or leave the field because of the stress. Workers distracted by issues at home or by ongoing muscular pain might be more likely to call in sick or if they do show up for work might provide less than attentive care, he speculates.

The study, authored by Kim and his colleagues, will be published in the online version of the American Journal of Industrial Medicine September 27. Kim says that the findings must be confirmed by additional research in order to prove a cause-and-effect relationship between work-family conflict and the aches and pains reported by workers in this study.

Even at this stage, the findings should push administrators to take a hard look at working conditions in hospitals. "Hospital employees who don't have to juggle extreme work hours and family obligations might be happier and more productive on the job," Kim said. "And that's a win-win situation that will benefit not just hospitals but also workers, patients?and family members."

The images of the pictures of the trainers are gigantic while the pictures in firefox chrome or safari are normal sized. I'm assuming it is a quirk with ie with css but I'm experienced enough to know what specifically should be fixed.

UPDATE: I have fixed the images part displaying the correct size but the cell that the picture is in is still the same size as when the picture was huge. What could be causing the cell to be huge in IE but not firefox, chrome, safari.

Ball of Flame Shoot Fire - Buddy - Music Review

With all the albums that get released in a year, it?s a Sisyphean task to keep track of everything, and many a worthy record inevitably goes sadly unrecognized. This being the case, it?s a pleasure to stumble on a band like Brooklyn-via-Pittsburgh quintet Ball of Flame Shoot Fires, whose excellent third album, Zileur (Mi?-?Mi?-?Mo?-?Mo) ??yep, that's its title ? deserves to find a larger audience.

Standout track ?Buddy? is a melancholic piece of indie folk with precise but precarious arrangements that channel Wolf Parade by way of Dirty Projectors. The track has a lot going on, including caterwauling horns and purposefully melodramatic strings, but the jazzified pop and complex arrangements never feel overwrought. ?It's just that no one ever said, 'Hey get out of here,'? lead crooner Jess Tambellini laments, grounding his vocal histrionics with the weight of a last-call drunk. We highly recommend checking out the rest of the album over at its Bandcamp.

Warnings that the global economy is embroiled in a ?currency war? were again raised by Brazilian Finance Minister Guido Mantega last week, following the US Federal Reserve?s announcement earlier this month that it would be undertaking another round of monetary stimulus. Brasilia?s plan to temporarily raise import tariffs on various goods has also ramped up tensions between the trading partners, as Brazilian officials - including the country?s president - argue that the measures are both WTO-consistent and necessary to counter the currency effects of developed country policy, amid Washington?s claims that the tariffs are protectionist.

US Federal Reserve?s move sparks unease in Brasilia

The 13 September announcement that the US Federal Reserve would be launching a third round of ?quantitative easing?- in other words, buying up assets, in this case mortgage-backed securities, to prop up the economy - has prompted harsh criticism from Mantega on various occasions over the past week, with the finance minister lambasting the Fed?s decision as a ?protectionist? one that would help the US little.

Instead, Mantega told the Financial Times, QE3 - as the Fed?s programme is commonly known- would only cause the dollar to depreciate while increasing US exports. Japan?s recent decision to expand its own quantitative easing programme was similarly criticised by the Brazilian finance minister. Mantega has argued that the US and others should instead pursue more fiscal measures, rather than relying too heavily on monetary policy.

?[The United States and Japan] will be stimulating the currency wars as [they] will lead all countries also to pursue these wars,? Mantega told reporters in London on Friday, in comments reported by Reuters. He added that the US Federal Reserve?s and the Bank of Japan?s moves would prompt other countries to act in defence of their economies.

The finance minister has lately said that, if necessary, his country could enact taxes on short-term capital inflows and other measures to prevent Brazil?s currency, the real, from appreciating.

Brazilian President Dilma Rousseff similarly lambasted the Federal Reserve?s decision during her address to the UN General Assembly on Tuesday.

?Monetary policy cannot possibly be the only answer to solve increasing unemployment, higher poverty levels, and lack of heart and lack of a future outlook which currently affect the most vulnerable layers of the population worldwide,? she said.

Noting the imbalance in foreign exchange rates caused by developed country central banks using such monetary policies, she told the audience that emerging economies will again lose market space as a result, due to their own currencies appreciating.

This latest round of quantitative easing is slated to continue until the US job market improves substantially, and involves the Federal Reserve?s buying US$40 billion a month in mortgage debt, in addition to other existing programmes for a total of US$85 billion in asset purchases per month.

Mantega first cautioned of a ?currency war? in September 2010, in a speech that made headlines worldwide and fuelled increased debate on the impact of currency valuation on export competitiveness. (See Bridges Weekly, 29 September 2010) Concerns over what critics deem ?excessively loose? monetary policy by developed economies - particularly the US and EU - has since been on the rise, with various developing countries arguing that such policies effectively ?export the crisis? to emerging and developing economies.

Brazil has been one of the most vocal critics of these measures, as the South American country has worked to push against an import surge exacerbated by the real?s continued appreciation. While the real?s appreciation has lately slowed, with the currency now being at what Mantega calls ?a reasonable value,? it is still ?overvalued against a basket of Brazil?s trading partners,? according to the minister.

The South American country has also pressed for discussions on the impact of exchange rates on trade to take place in the WTO context, which most recently led to the Geneva-based organisation holding a seminar on the subject. (See Bridges Weekly, 4 April 2012)

QE3 has been defended, however, by International Monetary Fund (IMF) Managing Director Christine Lagarde, who similarly praised the European Central Bank?s OMT bond-purchasing programme and Bank of Japan?s expanded Asset Purchase Program as ?big policy signals in the right direction.?

?They point the way forward and create an opportunity to build on what has been done; an opportunity to make a decisive turn in the crisis,? Lagarde said, while noting that prospects for the future remain uncertain.

WTO Director-General Pascal Lamy has similarly noted that ?recently announced measures to reinforce the euro and boost growth in the United States are? extremely welcome.?

Some analysts, such as Kevin Gallagher - a professor of international relations at Boston University - have urged the Federal Reserve to approach renewed quantitative easing with caution, with Gallagher urging in a recent Financial Times op-ed that the US use more fiscal policy and not just employ monetary policy.

Gallagher also suggested that the Federal Reserve pursue stronger financial regulation ?in order to ensure that financial institutions do not steer newfound liquidity into currency and commodity speculation in emerging markets and developing countries-speculation that can wreak havoc on developing countries? financial systems and growth prospects.?

Washington criticises Brazilian import tariffs

Meanwhile, Brazilian and US officials have also exchanged barbs over the South American country?s plans to temporarily increase import tariffs, ramping up tensions further between the two trading partners.

?I am writing to state in strong and clear terms the United States? concern about scheduled and proposed tariff increases in Brazil and Mercosur,? US Trade Representative Ron Kirk wrote in a letter to Brazilian Foreign Minister Antonio Patriota last week.

Brasilia plans to raise import tariffs on 100 products this month, with increases in rates of up to 25 percent for most products. Additional products are set to be added to that list in October.

The scheduled tariff increases are likely to ?significantly hit US exports to Brazil in key areas of export interest to the United States,? Kirk said in his letter, criticising these and earlier import tariff increases throughout the year as ?clearly represent[ing] protectionist measures? that could risk a response in kind from trading partners.

Brazil?s Foreign Ministry quickly countered the US trade official?s criticism, with a ministry spokesman calling the claims ?baseless.?

In his reply to the US trade official, Brazilian Foreign Minister Antonio Patriota argued that the currency effects of US monetary policy is forcing the South American country to tackle ?a flood of imported goods at artificially low prices.?

?It would be fairer if those increases [in US exports] took place in an environment not distorted by exchange rate misalignments and blatant government support,? Patriota said, adding that Brazil?s policies were WTO-consistent, unlike the ?illegal subsidisation of farm products by the United States, which impact Brazil and other developing countries, including some of the poorest countries in Africa.?

Rousseff similarly defended the trade measures during her UN speech on Tuesday. ?We cannot possibly accept that trade defence initiatives of developing countries be unfairly classified as protectionism,? she said, given that current rich country monetary policy is having the effect of worsening current global recession trends.

?It should be called to mind that legitimate trade defence measures are enshrined under the norms of the World Trade Organization,? she added, adding that protectionism and other forms of trade manipulation ?should be tackled inasmuch as they accord greater competitiveness in an illegitimate, spurious, and fraudulent fashion.

Benghazi attack a short-term setback for Libya investment revival

TRIPOLI (Reuters) - The taxi driver parked outside a luxury hotel in Tripoli says most of his business there has ground to a halt in the past two weeks.

Since an attack on the U.S. consulate in Benghazi on September 11 killed the U.S. ambassador and three other Americans, heightening fears for the safety of Westerners in Libya, there have been fewer foreign customers requesting his services.

"There has been a change, the foreigners are much more cautious now," the driver, who did not wish to be named so as not to be recognized, said. "They won't just come up to the taxi rank, they want to be careful. Some have gone, others are staying inside the hotel. But they're not going out with us."

The assault on the U.S. diplomatic mission was the most serious security incident in Libya since the end of the eight-month uprising that finished Muammar Gaddafi's 42-year rule last year.

Coupled with a lull in policymaking as the country awaits a new government that will take over soon from the interim administration, the attack risks scaring off foreign investors in the short term. It will also pressure the new administration to focus heavily on security, which could further delay much-needed reforms and reconstruction in Libya.

Security has been an issue as the country's new rulers have struggled to contain armed militias who have refused to give up their weapons since the war ended.

The Benghazi attack has led many companies to beef up security measures in Libyan cities, restricting staff movements, and as embassies warn against non-essential travel to the North African country, risk premiums are rising.

"Suddenly you will have people who won't be able to come because of insurance - companies may not send them because they see Libya as too risky," one foreign businessman in Tripoli said. "That will slow things down. And for those who had plans to bring their families here, that will be postponed."

Libya had been making progress in trying to attract foreign investment and stimulate its private sector: officials have been working to update a 2005 banking law which first allowed foreign banks into the country and have plans to introduce Islamic banking.

International oil companies were the first to return to the country after the uprising, helping oil production return to almost pre-war levels of 1.6 million barrels per day.

But recovery has been prone to setbacks: in July around half of Libya's oil-exporting capacity was temporarily shut down after protests by groups demanding more autonomy for eastern Libya, the source of most of the country's oil.

Major construction and transport projects have been untouched since last year, awaiting the authorities' approval to resume.

"The incoming government's focus will be so much on security, which has always rightly been a priority but there is now an added risk that restarting essential infrastructure projects may be put down the agenda in the immediate term," said Alex Warren of research and advisory firm Frontier, which runs The Libya Report business website.

Benghazi air space was temporarily closed after the attack, expatriate workers in the eastern city were relocated to Tripoli or fled overseas, and a British trade delegation was cancelled.

"What happened in Benghazi has a very negative impact because it may lead foreign businessmen to freeze plans to come and invest in Libya," said Issa al-Babaa, executive director of the Libyan Businessmen Council.

Yet the country's tiny stock market has barely reacted, dipping less than half a percent in the two weeks since the attack, according to Ahmed Karoud, general manager of the stock exchange, which lists about a dozen local companies.

That suggests the Benghazi attack may not have a lasting impact on business and, like in Iraq, foreign investors in the longer term may be willing to invest there despite security concerns if they see high returns.

CRACKDOWN ON MILITIAS

Many investors, including Chinese companies expected to bid for infrastructure projects, may not be deterred as violence has been directed mainly at Western targets.

"Given the current state of the economy, I don't think it's affected the macro picture or overall GDP growth. Oil production and trade has not been disrupted, there are no tourists to scare off and foreign investment is minimal at the moment," said Warren.

"But it's going to make it more difficult to move away from those current dynamics. Sentiment has been affected and the government will have to work harder to persuade foreign companies to come to Libya in the short term, given the added risk they will feel is involved."

Keen to make a break from the Gaddafi regime, the interim government said no major new concessions would be awarded until after the national assembly elections that were held in July.

The International Monetary Fund forecast in July that Libya's gross domestic product would double this year after shrinking 60 percent last year, helped by rebuilding and the release of pent-up private demand.

The attack is unlikely to hurt growth when oil accounts for the lion's share of revenues.

Libya aims to raise its oil production to 1.8 million bpd next year, above levels seen before the uprising.

But no new exploration and production contracts are expected for at least a year before a clearer landscape emerges from the OPEC member's democratic transition.

Gaddafi isolated the economy from much foreign competition, reserving licenses and contracts for his own circle, which makes some sectors attractive now he is gone, including telecommunications.

There are only two mobile operators, Al Madar and Libyana, which are both state-owned and a number of foreign telecom operators have been eying Libya including Etisalat of the United Arab Emirates, Qatar Telecom (Qtel) and Saudi Telecom.

Business potential highlights a lack of infrastructure which the new government will quickly need to address. In 2010, 14 percent of people in Libya were using the Internet, according to the International Telecommunications Union, compared with 49 percent in Morocco, 37 percent in Tunisia and 27 percent in Egypt.

The stock exchange has wanted to attract more foreign investors to trade shares since it reopened in February after closing during the war, but says rules on bringing funds into the country need to be relaxed.

"We are waiting for the new government to be formed. Nothing is known until then and we hope it will be stronger in making decisions," said Karoud.

The killings in Benghazi fuelled public anger at the continued presence on the streets of armed units, driving an Islamist militia, Ansar al-Sharia, out of the city on Saturday while the army ordered unauthorized armed groups to leave public premises in Tripoli as leaders vowed to dissolve rogue militias.

Central Bank Governor Saddek Omar Elkaber said the crackdown would be positive for the investment climate.

"What happened at the consulate eats away at the trust that has been gained in Libya," he said. "The steps now being taken are the right ones, it will help renew the trust for foreign investors."

In Benghazi itself, birthplace of the revolution, recovery could take longer, delaying regeneration after decades of neglect under Gaddafi, who fashioned the capital Tripoli into his power base at Benghazi's expense, its residents say.

"The events (are) going to delay things even more. Things were starting to look on the up. That is going to set them back, which is unfortunate," said Richard Weeks, a British engineer who has lived in Benghazi for more than 20 years.

Libya's second city, Benghazi is a major oil port but many foreigners working there were evacuated after the attack. Even before that, the city had seen several attacks on Western missions and organizations.

"Libya needs foreign business partners," a European worker said as he left Libya temporarily following the attack.

"But when even friendly Arab businessman are planning to leave and there is no government support to foreign companies, there are a lot of question marks."

Gay couple sues after photo used in anti-gay flier - U.S. News

Tom Privitere and Brian Edwards posed for their engagement photo, holding hands and kissing, in front of the Brooklyn Bridge in 2010. The image captured one of the happiest days of their lives. But earlier this year, their special moment was soured when the photo was used in two anti-gay mailers in Colorado.

On Wednesday, the couple and their photographer filed a lawsuit Wednesday in U.S. District Court in Colorado against Public Advocate of the United States, a nonprofit that opposes same-sex marriage. They are seeking a court order saying the group violated the law, damages, costs and attorney fees for the allegedly unauthorized use of the copyrighted photo.


?We want to take back the beautiful moment in our lives that was reflected in our engagement photo before it was hijacked,? Edwards, a 32-year-old college administrator living in Montclair, N.J., told NBC News on Monday before traveling to Colorado to file the lawsuit. ?We also ? want to take a stand for others who might be similarly targeted in the future.?

The couple, who met in New York in 2000, got engaged in December 2009. The next year in May, photographer Kristina Hill snapped their engagement photos. The pair married later that year in a civil ceremony in Connecticut.

?All that we did was what any other couple would do to mark their engagement and have these photos taken for family and friends to share our joy and our excitement and help people (see) what path we were taking toward our wedding,? said Privitere, 37. ?It was a great, great day for us.?

The couple alleged that Public Advocate seized upon that personal moment to spread what Edwards called a ?message of hate? in two mailers it sent this spring during Republican primary races for the Colorado statehouse.

One of the mailers targeted State Sen. Jean White, who supported a bill that would have granted same-sex civil unions. A friend alerted the couple to the mailers in late June. It?s not clear how Public Advocate got the photo, which the pair had posted to a blog about their engagement and impending nuptials. They say the group never asked the couple or Hill to use it.

Public Advocate did not immediately respond to emails or a phone call from NBC News seeking comment.

?The use of Tom and Brian?s likenesses, or of Kristina?s copyrighted photo, was wholly gratuitous,? said their attorney, Christine Sun, of the Southern Poverty Law Center. ?Public Advocate could have just paid for a stock photo of a gay couple kissing but instead Public Advocate decided to take this very personal photo of this happy moment and use it to attack gay people.?

? ? the doctrine of fair use is not intended to allow people to use copyrighted work just because it?s cheaper than paying for something,? she added.

The couple has experienced sleepless nights and anxiety since they learned of the mailer. They?re concerned about the impact of the mailers upon others who may have seen it, such as gay youth and families who may be struggling with accepting them.

?Colorado is a positive step in trying to right a wrong,? said Privitere, who works in entertainment ticketing. ?We?re nervous to be thrust into the public spotlight again. We?re nervous that we?re not going to represent our community the best that we can. But we?re going to do all that we can to try to fix or make this right.?

Bacon Pope painting unseen for decades up for U.S. auction

NEW YORK (Reuters) - A painting from Francis Bacon's iconic screaming Pope series, which has not been seen in public since 1975, is hitting the auction block where it is expected to sell for as much as $25 million, Sotheby's said on Thursday.

"Untitled (Pope)," which Bacon painted circa 1954, will be sold at the November 13 New York sale of impressionist and modern art, the auction house said in a statement.

"This is a great collecting opportunity," Oliver Barker, Sotheby's senior specialist for contemporary art, told Reuters in a telephone interview.

"Paintings of this nature have become tremendously important in terms of asset value," he said, adding that Bacon's early Pope paintings "are truly unattainable objects" with most gracing museum walls and only a few remaining in private hands.

Sotheby's said the work was last sold, and seen in public, in 1975, when a collector it declined to identify bought it for $71,500 at its London auction.

"The timing is absolutely right to capture the upward momentum of the Bacon market," Barker said, noting that prices in recent years "have been driven by an international reassessment of his works by the market".

Barker said Bacon's most desirable works were his Pope series.

Works by the British painter have commanded high prices. A female nude sold for $34 million in London in February, and his "Triptych, 1976" went for $86 million in New York in May 2008.

Art prices have recovered since the financial crisis, and Barker said several of the highest prices for Bacons had been realized in the last three or four years.

Sotheby's has estimated the painting will fetch $18 million to $25 million. It will go on exhibition in Los Angeles on Thursday and be shown in London and New York before the auction.

Automation Parts: Adhesives Make Car Repair Easier

Adhesive technologies are increasingly used in the car industry and in vehicle repair shops. Adhesive bonding is replacing conventional joining techniques such as welding, riveting or bolting. This not only increases safety but also simplifies many production operations. At Automechanika 2012, Henkel will be presenting recent product innovations and a broad product portfolio for reliable car repair in OEM quality.

Henkel has developed two new high-performance adhesives for repairing plastic components on vehicles and for bonding body parts. The new products are particularly low in emissions and thus offer excellent health and safety attributes. More and more automotive components ? from bumpers, fenders and spoilers to the fuel flap ? are made from plastics of every kind. If these components crack or break, then a dependable adhesive is required.

Teroson PU 9225 SF ME and Teroson PU 6700 ME
Mixing the two-component adhesives is extremely easy thanks to a special mixing nozzle that is used to apply them. The two components are mixed automatically in the nozzle, ensuring the optimal quality of the adhesive during application. Teroson PU 9225 SF ME can be used to repair all plastic parts on the vehicle exterior. The product has a pot life of two minutes, is applied at room temperature and subsequently cured using an infrared heat source at 60 to 70 degrees Celsius. Teroson PU 6700 ME is ideal for bonding different materials. The product can be used for metal, wood and most plastics and on painted surfaces. The adhesive cures in around ten minutes, regardless of the ambient temperature and the humidity level.

Low odour and low bloom: Loctite 403, 408 and 460
Loctite 403, 408 and 460 are three improved instant adhesives from Henkel that can be used for bonding virtually any materials. Already market leaders in terms of health and safety, these products now offer even better performance.

The three Loctite instant adhesives are suitable for bonding almost all materials, from plastic through metal to rubber. Thanks to a special formulation, they do not irritate the skin, nor does their safety data sheet list any hazard symbols or chemical substances that pose a risk to health. In launching these improved products, Henkel is strengthening its portfolio of innovative solutions with regard to occupational health and safety. The improved formulation has higher moisture tolerance and leads to a longer lasting bond.

Long processability, straightforward mixing: Terokal 5010 TR
Terokal 5010 TR, the two-component material being unveiled by Henkel at Automechanika, is an entirely new solution for the perfect repair of body damage ? and far superior to hot soldering using tin. The product, which is sold under the Teroson brand name, has been tested by the ?Allianz Zentrum fuer Technik? with positive results.

For workshops, the use of Terokal 5010 TR offers significant time and labour savings. In contrast to working with tin, no high temperatures are required and the vehicle components do not have to be dismantled and then fitted again following the repairs. Neither is there any impact on the plastic components close to the repair, as the application and curing temperatures are no higher than if the vehicle was standing in bright sunlight.

New flange sealant silicones suitable for throughout the vehicle
Sealing mechanical components is made even easier with Loctite new silicone products, Henkel is unveiling at this year?s Automechanika in Frankfurt. The innovative premium silicones were developed to satisfy the highest demands in automotive repair shops. Henkel is completing and optimising its silicone sealant line with two new products Loctite SI 5660 and Loctite SI 5990 in addition to the well-known Loctite SI 5980 Quick Gasket. The silicones can be used for sealing a variety of components on the vehicle, for example in the engine compartment they are used on the oil pan, water pump and valve covers. All three products adhere to both metals and plastics.

Henkel, the world?s largest manufacturer of adhesives, sealants and surface technologies, supplies the innovative products in a user-friendly ready-to-use cartridge developed especially for workshops. The sealant is applied from the pressurised cartridge through the integrated nozzle, without the need for an additional dispensing device.

Environmentally compatible corrosion protection at OEM level
Free from volatile organic compounds, or VOCs, the Terotex Aqua product line from Henkel is designed for corrosion protection on vehicles. Working with the products does not pose any risks to the user?s health, while the repair shop can reduce its VOC emissions.

Welded metal repairs, new body panels, retrofitted spoilers, tuning components and even spare parts are used during the repair work all require comprehensive corrosion protection. In most cases, only a primer has been applied to the parts and this is insufficient to prevent corrosion occurring in the long term. In addition, the existing corrosion protection may have been removed or damaged by welding, cutting or grinding work and the associated high temperatures. The result is weaknesses in the body that compromise the safety, comfort and look of the vehicle.

For comprehensive corrosion protection, Henkel has developed the Terotex Aqua product line for the auto repair industry. This high-quality coating range guarantees maximum corrosion protection and, because it does not contain solvents, also offers an environmentally friendly alternative to conventional products. The products do not pose any health risks for the workshop employee, while the workshop can reduce its VOC emissions in compliance with legislation.

Further training initiative with added value benefits for practitioners
Messe Frankfurt has launched a ?Further training? campaign as part of this year?s Automechanika. An important component of the campaign will be the ?accident damage repairs? training package. The goal here is to give interested participants practical sessions on this demanding area of work and allow them to try out tools and methods themselves. One workshop will be hosted by Henkel.

During the ?Body bonding techniques? workshop ? Henkel, with its Teroson branded products, will show participants chemical bonding materials as important elements of today?s vehicle bodies. They will receive information about health and safety regulations regarding the use of chemical products and will have the chance to apply the products themselves. Participants will also find out about the main tools used to apply sealants and adhesives. Here too there will be a hands-on component, the aim of which will be to return a vehicle body as closely as possible to its original appearance following the repair process.

Bobby?s day usually begins around six in the morning, preparing meals and getting the children and her husband, Johnny, ready for their day. To say her home is a whirlwind of activity for most of the day is an understatement.

For Bobby and Johnny, it?s a mission of sorts. They both had children from previous marriages, but their union was more than a simple marriage. It was the grand opening of their home.

?It wasn?t like ?those are your kids and these are mine,?? Johnny said. ?It?s all of us together. We?re all in it together.?

During the past four years, they?ve opened their home to more than 10 foster children, recently adopting three ? Chase, 15; Jada, 8; and Joseph, 3. Both coming from abusive and neglectful childhoods, Bobby and Johnny decided their home was going to be a haven, a safe place for children who needed attention, care and love.

?I?ve always wanted to protect abused children,? Bobby said. ?I wanted to help children who?ve been mistreated.?

Chase was removed from his home because of abuse and neglect. He was also physically and verbally aggressive. His first foster placement didn?t work well, but Bobby and Johnny were patient and Chase slowly transformed. He?s part of the family, and helps care for his younger sister and brother.

Joseph was born to a drug-addicted mother. He cried and wailed incessantly while his body weaned itself from the narcotics. He had to be soothed and held constantly. His sleep was erratic. Bobby and Johnny never wavered.

?We just held him and loved him,? Johnny said. ?There wasn?t anything else we could do.?

There are no signs of those troubles now, as Joseph and his freshly cut Mohawk hairdo speed from room to room and down the hallway with his sister. He laughs and plays just like any other 3-year-old boy.

Bobby runs children to doctor?s appointments and other things. In addition to the adopted children, they?re still foster parents to three other children. She calls them all by pet names and maintains an unending supply of affection and energy. To nearly everyone who goes in and out their front door, they?re called Mamaw and Papaw. But there are still standards.

?Oh yes, we?ve got rules,? Bobby said. ?We expect good grades in school, manners, and being respectful of adults and other children. They all have chores to do to help around the house. We expect them to mind.?

The children?s bedtime is usually around 8 in the evening. Bobby and Johnny end the evening cleaning and straightening up the circus of the previous 14 hours.

Most days, Bobby?s evening continues through to the wee hours of the next day.

?Having foster children is like this: It?s a lot of news, and it can be bad one day, good the next day and then great another day,? she said. ?It?s a lot of work and you have to be flexible. But we love all of them. It?s difficult sometimes when they leave ? you want them to go home to their families, but you get attached and you?re sad to see them leave.?

And then the next morning begins the daily routine. Bobby and Johnny said they?d take in more children if they could.

The children are safe. They?re loved. Most important, they?re happy.
